Terms of Use

1. Scope

These Terms of Use ("Terms") govern your access to and use of the website at bhtn.io and any subdomains (collectively, the "Site") operated by BHTN Technologies Inc., a Delaware corporation ("BHTN", "we", "us"). By accessing the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms do not govern use of the ZeRDA runtime, the BHTN portal SaaS, the BHTN SDKs, or any other BHTN product or service. Use of those products is governed by a separate written agreement between BHTN and the customer.

2. Informational purpose

Content on the Site — including architecture descriptions, performance measurements, pricing figures, comparison tables, and product roadmap — is provided for general informational purposes. It reflects our understanding at the time of publication and may be updated or removed without notice. Nothing on the Site constitutes an offer, binding quote, representation, warranty, or commitment. Any statement on the Site about future capabilities is forward-looking and subject to change.

3. Measurements and comparisons

Performance and validation claims published on the Site (for example, "sub-second class latency", "enterprise-grade throughput", "large-file end-to-end verification", "19/19 STRIDE mitigated", "$1,054/mo") reflect results measured or observed by BHTN in our own test environment at a specific point in time. Your results will vary with your workload, network, hardware, configuration, and operational posture.

Comparative pricing and capability tables reference publicly available information about third-party products at the time of publication. Third parties may change their pricing, features, or positioning without updating us; we endeavor to keep comparisons fair, but the authoritative source for any third-party product is that vendor. Trademarks remain the property of their respective owners; their use on the Site is nominative and does not imply endorsement or partnership.

4. Intellectual property

All content on the Site — including text, graphics, logos, the prism-beam mark, diagrams, video, code snippets, and page designs — is owned by BHTN Technologies Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for your own non-commercial reference and evaluation. Any other use — including reproduction, republication, modification, redistribution, framing, or incorporation into another work, product, or marketing asset — requires our prior written permission. The BHTN name, the ZeRDA name, the ZEN-D name, and the prism-beam mark are trademarks of BHTN Technologies Inc.

5. Acceptable use

You agree not to:

• Attempt to gain unauthorized access to any non-public portion of the Site or its underlying infrastructure.
• Interfere with, disrupt, or attempt to disable the Site (including denial-of-service attempts, scraping at volumes that degrade service, or circumvention of access controls).
• Introduce malware, or attempt to probe, scan, or test the vulnerability of any system without authorization. Coordinated security research is welcome — please email info@bhtn.io with the subject line "Security" first.
• Use the Site in a manner that violates applicable law, infringes third-party rights, or is reasonably likely to harm BHTN, our customers, or the public.
• Use automated systems to reproduce, mirror, or train on the Site's content without our prior written consent.

6. Third-party links

The Site may link to third-party websites (for example, LinkedIn, Plausible, GitHub). BHTN does not control those sites and is not responsible for their content, availability, privacy practices, or terms. A link is not an endorsement.

7. No warranty

The Site is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, BHTN disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. BHTN does not warrant that the Site will be error-free, secure, or continuously available.

8. Limitation of liability

To the maximum extent permitted by law, BHTN, its affiliates, and their respective officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, whether based on contract, tort, statute, or any other legal theory, and whether or not BHTN has been advised of the possibility of such damages.

BHTN's aggregate liability arising out of or relating to these Terms or your use of the Site will not exceed one hundred U.S. dollars (US$100).

9. Indemnification

You agree to defend, indemnify, and hold harmless BHTN, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site.

10. Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Exclusive jurisdiction and venue for any dispute arising out of or related to these Terms or the Site will lie in the state and federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

11. Changes to the Terms

We may update these Terms at any time. Updates are effective when posted, and the "Last updated" date at the top of this page will be revised. Continued use of the Site after an update constitutes acceptance of the revised Terms.

12. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BHTN with respect to the Site.
